Changes to Motorcycle Policies in 2005

Rule 44.  Motorcycles, Motorscooters, Mopeds and Similar Motor in the Private Passenger manual has changed dramatically.  Motorcycles will now be rated as experienced or inexperienced based upon the date of licensing for the motorcycle.  The inexperienced classification (a 50% surcharge) will be applied to Coverage Parts 1, 2, 4, 5, 7 and 8.  All other coverages will be based upon the applicable Cubic Centimeter Engine Displacement group.

The following additions to the rule explain the rating process:

Experienced or inexperienced operator classifications apply to coverage parts 1, 2, 4, 5, 7 and 8.  The experienced operator classification is applied when all operators of the motorcycle have been licensed to operate a motorcycle for at least six years.  The inexperienced operator class is applied when any operator of the motorcycle has been licensed to operate a motorcycle for less than six years, or holds a motorcycle permit.  When an inexperienced operator classification is applied to a motorcycle, the rates for parts 1, 2, 4, 5, 7 and 8 must be multiplied by a factor of 1.50.  The Safe Driver Insurance Plan step assigned to an operator on a private passenger automobile insurance policy, if available, shall be applied to the motorcycle policy in accordance with Safe Driver Insurance Plan administrative procedures.  If there is more than one motorcycle on a policy, any inexperienced operators shall be assigned to the motorcycle with the highest sum of premium for Parts 1, 2, 4, 5, 7, 8 and 9 before application of any available credit, surcharge, or discount.  Any motorcycles remaining after assignment of all inexperienced operators shall be assigned an experienced operator classification.  If an inexperienced operator is the only listed operator on the policy, all motorcycles shall be assigned an inexperienced operator classification.

WHO WOULD BE CONSIDERED AN UNDESIRABLE RISK IN A COMPETITIVE RATING SYSTEM?

Automobile insurance premiums should be based, as much as possible, on driving record,
rather than factors unrelated to an individual’s driving record and experience.

Competitive rating will introduce into Massachusetts a variety of underwriting factors
unrelated to one’s driving record and experience.

Factors used to determine an individual’s automobile insurance premium in
Massachusetts:

• Years of driving experience;
• Driving record;
• Territory (city, town).

Additional factors used in competitive rating states to determine an individual’s
automobile insurance premium and likely to be used in Massachusetts if competitive
rating is introduced:

• Credit-based insurance score;
• Education and occupation;
• Not-at-fault accidents;
• Incidents of household members;
• Comprehensive losses (example, broken windows, theft);
• Financial stability example, tax liens, foreclosures, etc.):
• Vehicle type (certain vehicles will not be insured);
• Prior continuous insurance coverage;
• Amount of coverage purchased;
• Minimum coverage requirements.

The introduction of these and other rating factors will result in many good
Massachusetts drivers being considered undesirable risks under a competitive rating
system.
